Abstract
As a part of a broader study into medical error communication in Switzerland, 23 key medico-legal informants in Switzerland were interviewed. A major theme to emerge from these discussions was the issue of criminal liability. This article presents these findings and considers whether the current system in Switzerland is a morally meaningful and just system of culpability in light of theoretical and ethical considerations.
