Schiedsgerichte in den Aussenverträgen der EU. Neue Entwicklungen unter Einbezug der institutionellen Verhandlungen Schweiz–EU

The EU's negotiations on major trade agreements in recent years have shown a trend towards new arbitration mechanisms. In the bilateral agreements and institutional negotiations between Switzerland and the EU, too, arbitration courts have recently reappeared. In both cases, however, the EU's principle of the autonomy of Union law sets limits to the design of dispute settlement mechanisms by reserving the CJEU a decisive role in the interpretation of agreement law for certain constellations.
