Abstract

This article explains the legal basis for the determination of the jurisdiction and the governing law in both Switzerland and the European Union if the parties to a construction contract have not reached an agreement on the dispute resolution mechanism or the governing substantive law, respectively. With regard to the applicable law, this article focuses on the ongoing debate surrounding the impact of mandatory provisions and explores whether it makes a difference if the parties resort to arbitration in an EU country or Switzerland.
